The following General Terms and Conditions apply to STUD&GLOBE, S.L. package travel contracts:
The purchase of Package Travel is subject to the provisions set out in Royal Legislative Decree 1/2007 of November 16, as well as the transposition of the European Union Directive on Package Travel and related travel services in accordance with Royal Legislative Decree 23/2018 of December 21. Article Four. Amendment of the revised text of the Spanish General Law on the Defense of Consumers and Users and other complementary laws.
These General Terms and Conditions are incorporated, signed by the Customer, as a sign of the Traveler’s knowledge and acceptance of each and every one of these conditions, into all package travel contracts, the subject matter of which encompasses the programs/offers contained in the quotation given to the Customer, and they are binding on the parties, together with the specific conditions agreed in the package travel contract or present in the travel documentation provided at the time the contract is concluded. These General Conditions apply to the services set out in the contract, as provided for in article 151.1.a) of the aforementioned Royal Legislative Decree 1/2007.
Beneficiary: Individual for whom the Customer undertakes to purchase the Package Tour.
Transferee: Natural person to whom the contracting party or beneficiary transfers the package tour. Customer : Natural or legal person who purchases or undertakes to purchase the Package Tour.
Package Travel Contract: Document which sets out the specific conditions and characteristics of the services of each package tour by the Tour Operator, as well as the present General Conditions which form an integral part of the said contract.
Specific conditions: All the terms and special conditions governing the provision of a particular Travel Service by the Provider and which are set out before the booking is confirmed on the Web Site or on the Provider’s Web page.
Distributor: Natural or legal person who sells or offers for sale the package tour proposed by a Tour Operator.
Travel Organizer: Natural or legal person who organizes, on a non-casual basis, package tours, or who sells or offers them for sale, directly or through a distributor. Quotation: Travel quotation including the pre-contractual information that the Travel Organizer gives to each Customer, as well as the present General Terms and Conditions, which form an integral part of the latter.
Service Provider: Company in charge of providing a Travel Service.
Travel Services: Tourist services and activities provided by the Providers to meet the needs of Travellers. The main Travel Services include transport, accommodation, leisure activities, insurance, etc. Traveler: Any person recognized as a Customer or a Beneficiary. Package travel: In accordance with article 2 of the law relating to consumers and users, this refers to travel with a preliminary combination, sold or offered for sale on the basis of a global price and made up of at least two of the following elements: Transport; Accommodation; Other tourist services not ancillary to transport or accommodation and constituting an important element of the package tour; provided the said service exceeds 24 hours or includes an overnight stay.
STUD&GLOBE makes a conditional offer to the Customer detailed in a Quotation, on paper or in a durable digital format.
Prior to the customer’s acceptance, any pre-contractual information that has not been communicated to him or her earlier, together with the Standard Information Form, will be given to him or her, as required by law.
Following the Customer’s order, the Customer makes a deposit and STUD&GLOBE takes the appropriate steps to obtain confirmation of the requested Travel Services from each Supplier. If any of the said services cannot be confirmed due to lack of availability, a similar service is offered to the Customer, indicating the new price and, where appropriate, the Customer may accept or refuse it.
Once the final offer has been accepted, or the changes proposed to the Customer, the contract is deemed concluded and the corresponding documentation is sent to the Customer. If the Customer refuses the proposed change, any amounts previously deposited are refunded.
The travel reservation is confirmed when the Package Travel Contract is signed and the advance payment required by STUD&GLOBE is made. No booking is considered firm without this payment. The Package Travel Contract must be respected from that moment onwards.
STUD&GLOBE may cancel the Package Travel Contract and refund to the Customer all payments made by the Customer, but is not obliged to pay any additional compensation if:
STUD&GLOBE will then reimburse the Customer, as required in the preceding paragraphs, within a reasonable period not exceeding in any case 14 calendar days from the date of notification.
The package tour is provided in accordance with the Package Tour Contract signed by the Customer. However, the Package Travel Contract may be modified in the following cases:
In the cases set out in letters c), d) and e), the Customer may accept the proposed change, accept another travel offer of equivalent or higher quality, or cancel the contract without penalty.
Any modification is notified to the Customer without delay, including the proposed modification, the deadline by which the Customer must respond, the indication that failure to respond means that the Customer opts for cancellation without penalty and, if applicable, the proposed alternative package tour, its price and the corresponding refund or price increase.
If the Customer chooses to cancel the contract, the refund will be made within 14 calendar days from the date of express notification of said choice to the Tour Organizer, without prejudice to the Customer’s right to receive compensation for any damage or loss suffered and which may justify said cancellation.
2. MODIFICATIONS DURING THE PERFORMANCE OF THE CONTRACT
If a significant part of the travel services cannot be provided in accordance with the provisions agreed in the Package Travel Agreement, STUD&GLOBE offers, at no additional cost to the Customer, suitable alternative arrangements, if possible of equivalent or higher quality than those specified in the Package Travel Agreement, to continue the Package Travel, even if the Traveller’s return to the point of departure does not comply with the agreed conditions.
If the alternatives proposed alter the quality of a package tour, STUD&GLOBE will apply an appropriate price reduction.
The Customer may refuse the proposed alternatives if they are not similar to those agreed in the Package Travel Contract or if the price reduction is insufficient.
1 Liability of STUD&GLOBE: The Tour Operator and the Distributor are jointly and severally liable to the Customer and/or Traveller for the proper execution of the Package Travel Contract. STUD&GLOBE is liable to the Customer and/or Traveller if it carries out the services included in the Package Tour itself, as if its Service Providers were responsible for them.
Package Travel Services are deemed to be in conformity, unless otherwise specified by the Customer.
The Customer is obliged to take the necessary and/or appropriate measures to attempt to reduce the damage that may arise from the non-performance or improper performance of the contract in order to avoid any aggravation, by informing the Tour Organizer within a maximum of 48 hours by post to the following address: calle Balmes 357 – 5-4 08006 Barcelona or by e-mail to the following address: CONTACT@STUDANDGLOBE.COM . Damages arising from failure to take such measures are the responsibility of the Customer and the Traveller.
2 Right to price reduction, compensation and limitations : The Customer is entitled to an appropriate reduction in price for any period during which a lack of conformity has occurred. Furthermore, the Customer is entitled to receive compensation for any damage or loss suffered as a result of any failure to comply with the terms of the Contract. The Customer is not entitled to damages if STUD&GLOBE proves that the lack of conformity is :
3. When the services of the Package Travel Contract are governed by international conventions, the limitations concerning the scope or conditions of payment of compensation for the Service Providers included in the trip apply to the Tour Operator and/or the Distributor.

5. The compensation or price reduction granted under Royal Legislative Decree 1/2007 and that granted under the regulations and international conventions linked to article 165.5 of Royal Legislative Decree 1/2007 are deducted from each other in order to avoid overcompensation.

For the execution of the package tour: the Tour Operator and the Distributor are responsible to the Traveller for the proper execution of the travel services included in the Package Tour Contract, according to the obligations that correspond to their area of management of the package tour, whether said services are executed by them or by other Service Providers.

In the event of booking errors: the Tour Operator and, where applicable, the Distributor, are liable for errors due to technical faults in the booking system for which they are responsible, as well as for errors made during the booking process, when they have agreed to manage the booking of a Package Tour.
The Travel Organizer and, where applicable, the Distributor, are not liable for booking errors attributable to the Traveler, nor in the event of unavoidable and exceptional circumstances.
STUD&GLOBE provides the necessary assistance within a reasonable time to the Traveller in difficulty, in particular through: the provision of appropriate information on health services, local authorities and consular assistance, and assistance to the Traveller in establishing remote communications and the necessary help in finding alternative travel arrangements.
STUD&GLOBE may charge a reasonable surcharge for said assistance if the difficulty has been caused deliberately or by the negligence of the Traveller. Said surcharge shall in no event exceed the actual costs incurred by the Tour Operator and/or Distributor.
All Travellers, without exception (including children), must hold valid personal and family documents, whether passport or identity card, in accordance with the laws of the country or countries they are visiting. Travelers are responsible for obtaining visas, passports, vaccination certificates, etc. when required for travel. In the event of refusal to grant a visa by any Authority, for particular reasons, or in the event of refusal of entry into the country due to non-compliance with the requirements, a defect in the documents required or failure to hold the latter, STUD&GLOBLE declines all responsibility for facts of this nature. All resulting costs are to be borne by the Traveller, and the conditions and rules established in these circumstances apply in the event of voluntary renunciation of services. All Travelers, in particular those of non-Spanish nationality, are reminded that they must ensure, prior to the start of the trip, that they have complied with all applicable visa rules and requirements in order to gain easy entry to all the countries they will be visiting. Persons under 18 years of age must be in possession of a written authorization signed by their parents or guardians, which may be requested by any authority.
The Distributor provides the customer with information on the specific documents required for the chosen trip, as well as advice on taking out optional insurance to cover cancellation costs and/or medical insurance to cover repatriation costs in the event of accident, illness or death.
Before confirming the booking, students with reduced mobility must inform the Distributor of the situation in order to assess the possibility of purchasing and the feasibility of the Travel Services or the Package Tour in accordance with its characteristics.
In accordance with the provisions set out in EC Regulation 1107/2006 concerning the rights of disabled persons and persons with reduced mobility, a person with reduced mobility is any person whose mobility, in order to enjoy the Travel Services or participate in the Package Tour, is reduced due to a physical disability (sensory or motor, permanent or temporary), a disability or intellectual impairment, any other cause of disability, age, and whose situation requires special attention and adaptation to his or her specific needs of the Travel Services made available to the other participants in the Tour.
Baggage restrictions are determined by the rules of each carrier.
The processing and use of personal data provided by the Customer to STUD&GLOBE are defined in the “Privacy Policy” section of the www.studandglobe.com website, which also forms part of these general terms and conditions.
The Traveler is required to comply with government documentation requirements (passport, visas or other travel documents) in order to enter a foreign country when the trip involves stays or stopovers abroad. The Traveler is therefore advised to check the conditions required in each case before booking the trip. Information on entry requirements for foreign countries can be found on the Spanish Ministry of Foreign Affairs website (www.mae.es). If the Traveler does not comply with all the requirements necessary to enter the destination country before the start of the trip, STUD&GLOBE is in no way liable for the impossibility of benefiting from the services purchased, nor are the Providers if STUD&GLOBE acts as a mere intermediary.
Passports must be valid for the entire duration of your stay abroad. Indeed, some countries may require the passport to be valid for at least 6 months from the date of entry into the country. If your passport is valid for less than a year, we recommend that you find out about entry requirements before booking your trip. For trips abroad, it is recommended that the passenger details provided at the time of booking correspond exactly to those on the passport. STUD&GLOBE will not refund any amount for this reason if a Traveler is unable to benefit from certain purchased Services.
As far as visas are concerned, in some countries they can take a long time to be issued. The Traveler is therefore advised to send in his visa application well in advance, and to make sure he has all the necessary information about visa requirements before booking his trip. For trips with one or more stopovers in various countries, the Traveler must ensure that he/she complies with the entry requirements for each country.
Visa requirements are subject to change. It is therefore advisable to consult them before booking your trip and before starting it.

Finally, travel to certain destinations may present more risks for travelers than others. STUD&GLOBE’s offer of a given destination does not imply that STUD&GLOBE guarantees that said destination or country is risk-free. To this end, the Traveller is required to check the level of risk of the destination or countries of transit before booking the trip and before starting the trip. All information concerning the conditions for travel to each destination and the associated level of risk is available on the web page of the Spanish Ministry of Foreign Affairs(www.mae.es).
1.complaints : The Customer may send written complaints regarding the non-performance or improper performance of the Package Travel Contract by post to the following address: calle BALMES,357 08006 – BARCELONA or by e-mail to the following address: contact@studandglobe.com STUD&GLOBE has a maximum of 30 days to respond in writing to the complaints made. STUD&GLOBE also points out that the internal procedure is divided into several stages: (i) Reception and acknowledgement of receipt; (ii) Processing, collection of information, assessment; (iii) Final decision and dispatch of reply.
2 Legal action: If the dispute is not subject to the consumer arbitration system, the Customer may institute legal proceedings. The limitation period for legal actions arising from the Package Travel Contract is 2 years.
